PillCounter Terms of Use

These Terms of Use ("Terms") are between Eric Hakhyeon Lee, located in Ontario, Canada ("we," "us," or "our"), and the person or organization using PillCounter ("you"). By using PillCounter, you agree to these Terms. If you use it for an organization, you confirm that you are authorized to do so.

The product

PillCounter is an assistive photo-counting tool for tablets and capsules. It presents an unverified estimated count and markers for review. Accurate uses cloud processing plus an on-device cross-check; Free includes up to twenty Accurate counts per day and Pro includes unlimited Accurate counts. Speed is the unlimited on-device mode and may be less accurate.

The Free allowances, offline pacing, and no-expiry history described here apply to app version 1.3.3 and later, subject to update availability in Google Play. Earlier versions may still limit Free to three Accurate counts per day and automatically delete Free history after ten days. Update before that expiry or export records you need to keep; updating cannot restore previously deleted records.

PillCounter can make mistakes, including missed pills, duplicate detections, split capsules, false detections, and incorrect counts caused by overlap, appearance, lighting, glare, blur, framing, scale, camera behavior, network availability, or system limitations.

Mandatory independent review

You must inspect every marker, review every detection, and independently verify every count before relying on it. PillCounter must not be the sole control for dispensing, inventory reconciliation, medication identity, dose selection, clinical decisions, or any situation where an incorrect count could cause harm. You remain responsible for professional judgment, workplace procedures, independent checks, supervision, records, and compliance.

Not medical advice or a medical device

PillCounter is not a medical device and does not diagnose, treat, cure, or prevent any condition. It does not identify medication, determine a dose, recommend treatment, or replace a pharmacist, prescriber, or qualified healthcare professional. It is offered only as an assisted counting aid, and every result remains unverified until the user reviews it.

Cloud, offline, privacy, and patient information

Accurate sends the selected count photo over an encrypted connection to a third-party cloud counting service. Speed keeps the count photo on the device but may perform less accurately on difficult pills. Network failure, capacity limits, app attestation, or provider outages may prevent a cloud result or require a retry.

The Privacy Policy explains processing, providers, retention, security, and deletion. Keep patient information and other identifying information outside photos, including names, prescription labels, Rx numbers, birth dates, addresses, health-card numbers, paperwork, screens, and faces. This public beta is not offered for workflows that require PillCounter to receive protected or identifying patient information.

Corrections and training

The reviewed-correction sharing preference is on by default, but no correction uploads automatically. A correction is submitted only when the user presses Send for review after reviewing the dots. Before the first submission, the app identifies the uploaded photo, dots, predictions, count details, and improvement purpose and offers Keep on device. You retain responsibility for submitted photos, must have authority to process them, and must keep patient and other identifying information outside them. The Privacy Policy describes submission storage, training use, retention, and deletion.

Eligibility and acceptable use

PillCounter is intended for adults. You may use it only where lawful and with compatible devices and environments. You may not bypass verification or safety controls, process data without authority, attack or disrupt the service, evade limits, extract secrets, infringe rights, make unsupported accuracy or compliance claims, or use PillCounter unlawfully.

License, ownership, and changes

We grant you a limited, non-exclusive, non-transferable, revocable license to install and use PillCounter for its intended purpose under these Terms. The app, software, service, and branding remain owned by us or our licensors. We may maintain, update, suspend, or discontinue features for safety, security, provider, legal, or technical reasons. During the public beta, PillCounter is offered without a service-level or continued-availability commitment.

Free, Pro, and billing

Free includes unlimited Speed with a deliberate four-second minimum per offline count, up to twenty Accurate counts per day, and three Burst photos per day. The offline wait is free-tier pacing, not additional analysis. Slow counts can take longer than four seconds. Pro includes unlimited Accurate counts, unlimited Burst, and no added offline pacing. Free and Pro on-device count history has no automatic expiry and remains until the user deletes it, clears app data, or uninstalls.

Online counts depend on service availability. Free online capacity is shared and may run out before an individual's daily allowance. Pro has reserved online capacity but is also subject to service outages and infrastructure safety limits. Offline counting remains available. Failed online counts do not consume the free daily allowance.

Additional Accurate counts and Burst beyond the Free daily limits require Pill Counter Pro unless an express trial or promotion applies. Google Play displays the localized price, billing period, trial or introductory eligibility, renewal date, and cancellation terms before purchase. Subscriptions renew automatically until cancelled through Google Play. Cancellation stops future renewal but access normally continues through the paid period. Refunds, payment failures, grace periods, pauses, and account management are governed by Google Play and applicable law.

Warranties and liability

To the maximum extent permitted by law, PillCounter is supplied "as is" and "as available" without a warrant or warranty of accuracy, uninterrupted availability, merchantability, fitness for a particular purpose, or non-infringement. Mandatory warranties and consumer rights remain unaffected.

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive loss, or for loss arising from an unverified count, failure to independently verify, service interruption, or unauthorized patient data. Where liability cannot be excluded, it is limited to the greater of the amount you paid us for PillCounter during the preceding twelve months or CAD $100, except where applicable law requires a different result. Nothing excludes liability that cannot legally be excluded.

Termination

You may stop using PillCounter at any time. We may suspend or terminate access for abuse, security threats, unlawful use, material breach of these Terms, or discontinuation. Provisions concerning ownership, disclaimers, liability, governing law, and accrued rights survive termination to the extent legally applicable.

Governing law and general terms

These Terms and any dispute are governed by the laws of Ontario and the federal laws of Canada applicable there, without overriding mandatory consumer protections or conflict-of-law rules that cannot be waived. Courts with lawful jurisdiction may hear disputes unless the parties agree otherwise. If a provision is unenforceable, the rest remains effective. Failure to enforce a term is not a waiver. We may assign these Terms as part of a lawful business transfer; you may not assign them without consent. Events outside reasonable control may excuse delayed performance. These Terms and the Privacy Policy form the entire agreement for the public beta.

Changes and contact

We may update these Terms for product, safety, provider, legal, or operational changes and will post a revised effective date. Material changes will receive any notice required by law. Questions may be sent to mrlightsource@gmail.com.
